Guide: Step-by-Step Calculation of Foreigner's Fine

The following is a step-by-step guide to help you with your Fine Calculation procedure.

STEP 1

Go to tramites.extranjeria.gob.cl with your ClaveÚnica or by creating an account on the Servicio Nacional de Migraciones. If you do not know how to create an account or you already have an account and want to recover it, check the following articles:

STEP 2

-Once you have selected “Cálculo de Multa” you will see the “introducción” of the procedure with its respective recommendations. It will allow you to make your calculation and your “discargos” completely online.

-Los descargos: There is the possibility to state all factual and legal circumstances that you may consider necessary to defend your interests regarding the infraction that has been notified at the beginning of this fine procedure.

STEP 3

Then you will see the terms and conditions of the procedure. When accepted "You declare to have read the terms and conditions of the procedure; and your willingness to be notified of the process by email," then click "Siguiente".

STEP 4

You must enter the requested information and upload your legible identity document. The email address must be one that you currently use, since you will receive the information to that email. Then click on "siguiente".

STEP 5

You must select the reason for your fine, and if you had a previous sanction for the reason mentioned above. Then click on "siguiente". 

There are three reasons:

 -Delay in applying for identity card (Article106). 

- Expiration of immigration permit (Article 107/119).

- I worked without being authorized to do so (Article 109).

STEP 6

If your fine corresponds to "Vencimiento de permiso migratorio " (Expiration of immigration permit (Article 107/119)) You must select the type of residence, then the expiration date of your immigration benefit.

- If it corresponds to Permanencia Transitoria: you must indicate the expiration date of your permit.

- If it corresponds to Residencia Temporal: you must mention the day your Residencia Temporal permit expired.

STEP 7

If your fine is due to "Realicé trabajo sin estar habilitado o autorizado para ello" (I worked without being authorized to do so) (Article 109)), you must indicate the expiration date of your immigration benefit.

-If it corresponds to Permanencia Transitoria: indicate the expiration date of your permit.

-If it corresponds to Residencia Temporal: you must mention the day your Residencia Temporal permit expired.

STEP 8

You must confirm and submit the application form to the next step by clicking on "Finalizar".

Then you must click on "siguiente".

STEP 9

-In this step you can make your "descargos".

There is the possibility to state all factual and legal circumstances that you may consider necessary to defend your interests regarding the infraction that has been notified at the beginning of this fine procedure.

-You have a period of 10 working days to present your defense. 

-In your “descargos” you may attach any documentation that you deem pertinent and that serves to ratify what is expressed.

STEP 10

In this step, you must decide whether you will make the “descargos” or not, by choosing one of the options.

STEP 11

If you choose the option "Si", you will be able to make your “descargos”:

1.You must upload the documentation that certifies what has been notified. 

2. In the box, you can write down the reason with a limit of 500 characters.

Then click on "siguiente".

STEP 12

Once you have completed your “descargos”, you will receive a notification to the email address stated in your application, confirming that your application has been received.

Servicio Nacional de Migraciones will evaluate your background history and the supporting documentation. Once a decision has been made, you will be notified by the same email.

STEP 13

On the other hand, if you choose the "NO" option, you are waiving your right to file a "descargo" against the financial sanction. Therefore, a resolution of fine will be issued for the amount indicated.
