Step-by-Step guide to apply for a permit for foreigners engaged in lawful remunerated activities

It is a permit granted to those foreigners who wish to reside in Chile for a limited period of time, in order to engage in lawful remunerated activities under a subordinate or dependent relationship with an employer.


This residence permit must be requested from abroad through tramites.serviciomigraciones.cl option "Solicitud de Residencias Temporales para Extranjeros fuera de Chile" (Application for Temporary Residence for Foreigners outside Chile).


You will be able to enter with ClaveÚnica or by creating an account from the Servicio Nacional de Migraciones.


1. Once you have logged in, you must complete the form with the applicant's information:

- Sex

- Country of birth

- Nationality

2. Then enter your contact information:

- Country and city of current residence

- Cell phone number and email address


IMPORTANT: Make sure to enter a valid email address. The information you will receive from the Servicio Nacional de Migraciones will be via email. 

3. In this section, you will have to complete the following information:

- Type of identification document

- Country that issued the identification document

- Date of expiration of the identification document


4. In the next step, please indicate the activity to be performed and your educational level.

-Educational level.

- Profession/Occupation

- Activity to be performed in Chile


Then click on "Siguiente".


5. Complete the following information:

- Type of identification document

- Identification document number

- Country that issued the identification document


Then  the requested documentation legible, valid and legalized as applicable.

- Copy of the identification document

- Criminal record certificate from your country of origin


IMPORTANT: If you have been residing in a country other than your country of origin for more than 5 years, you must attach a certificate or equivalent document from the competent authority. 


Then click on "Siguiente".




6. Select the quality of the Residencia Temporal to apply for (holder/dependent). Then click on “Siguiente”.


7. Indicate the type of Residencia Temporal to apply for. In this case, you must select "Motivos Económicos” (Economic Reasons) and then "Desarrollo actividades remuneradas cuenta propia o contrato” (you engage in remunerated activities on your own account or contract).



8. You must select whether you are coming to Chile to comply with a service agreement governed by the Civil Code or an employment contract governed by Chilean labor regulations.



If your request corresponds to Prestación de Servicios como Honorarios (Rendering of Services)


Please enter the following information:

- Name of the institution and/or company where you will perform such activities.

- Tax ID number of the institution and/or company

Telephone number of the institution and/or company


Then attach your Contrato de prestación de servicios (Service Contract).

It must comply with the labor provisions in force, specifying tasks and remuneration, signed before a Notary Public, by the service provider and the contractor, indicating the company's RUT (Tax Identification Number or Identity Card) if you are a natural person. It must also include a claúsula de vigencia y de impuesto a la renta (clause of validity and income tax) if applicable.




If you are applying under an Employment Contract, please enter the following information:

- Name of the institution and/or company where you will perform the activities.

- Tax ID number of the institution and/or company

Telephone number of the institution and/or company

Then attach your Employment Contract. This must be signed with a natural or legal person, with a mailing address or branch in Chile, and inicio de actividad (start of activity certificate) in force before the Chilean Internal Revenue Service (SII). The duration cannot be less than 3 months. It must be signed by the employer before a Chilean notary public, while the foreigner must sign it before the Consulate that is competent according to the provisions of the Consular Regulations.



If you are applying with a Job Offer

Please enter the following information:

- Name of the institution and/or company where you will perform the activities.

- Tax ID number of the institution and/or company

Telephone number of the institution and/or company

Then attach your Job Offer. It must be issued by the employer located in Chile, and it must be notarized by a Chilean notary public. You must also upload your Letter of Acceptance from the foreigner regarding the Job Offer.




Self-Employed Application (Entrepreneurs/ business owners)

Please enter the following information:

- Name of the institution and/or company where you will perform the activities.

- Tax ID number of the institution and/or company

Telephone number of the institution and/or company

Then attach a document describing the project, activity, activity to be performed and a document that proves that the capital has entered or will enter Chile.

You may certify it through bank statements or customs documentation or any other suitable document in the name of the interested party, which demonstrates income or goods from abroad to Chile.



For Profit

If the person with whom you have signed the contract or agreement for the provision of services is a for-profit legal entity, you must attach the following documents:

- Certificado de Inicio de Actividades (This document is issued by SII, the Chilean Internal Revenue Service).

- Employer's or Contractor's Tax Folder (Optional)

- Document stating the ownership or legal representation of the legal entity that subscribes to the employment contract or service provision agreement (Must be notarized).



Non-Profit

If the person with whom you have signed the contract or agreement for the provision of services is a non-profit legal entity, you must attach the following documents:

- Certificate of validity of the legal personality issued by the Servicio de Registro Civil e Identificación (SCRel, Civil Registry and Identification Service).

- Certificate of validity of the legal personality directory issued by the Servicio de Registro Civil e Identificación (SCRel, Civil Registry and Identification Service). 


Natural Person

You must attach documents that certify, by means of suitable documentation, that you have the resources to hire the worker.



9. Verify that all your information is correct and click on "Siguiente".




10. In this step, you must click on "Siguiente" to pay the processing fees, according to the type of benefit requested.


11. Click on "Finalizar" to proceed to the payment step.

 

IMPORTANTE: If your country of nationality has some kind of agreement with Chile, it is possible that your fee payment will be free of charge depending on the type of benefit requested. If that is the case, you will be redirected to the last page where you will have to finish the process.


 If you are under 18 years old, the form will also redirect you to the last page where you will have to finish the process.


12. Your application is ready to be submitted by clicking on "Enviar solicitud” (Submit application).


13. You will finally receive, in the mail declared in your application, a notification indicating that your submission has been successfully received. You will be contacted via email when the analysis process begins.
